IMPORTANT – DEADLINES FOR EXISTING GROUNDS UNDER SECTION 8 (HOUSING ACT 1988!
The Renters Right Act 2026 commencement date of 01 May 2026 is fast-approaching. As you may be aware, this Act amends the existing grounds for possession under Section 8 and provides for new notice periods. If you wish to rely on old grounds for Section 8, you will want to take note of the following dates: –
Service of Notices – 30 April 2026.
Issue of Proceedings – this will either be (depending on which comes first):
- 12 months after the date you gave the notice; or
- 31 July 2026.
Please note that the above deadlines are for the existing grounds for possession with the current notice periods. Thereafter, you will need to rely upon Section 8 eviction proceedings under the new grounds available under the Renters Right Act 2025 with longer notice periods (on most grounds).
It is vital to ensure that you have served a valid Section 8 Notice and that you have taken all necessary steps in accordance with the above deadlines. It may be your last chance to get the shorter notice period and lower rent arrears threshold.
